HidzoVPN – Terms and Conditions

Welcome to HidzoVPN. These Terms of Service (“Terms”) form a binding agreement between you and HidzoVPN (“HidzoVPN,” “we,” “us,” or “our”). By downloading our applications, creating an account, or using our services, you agree to these Terms. If you do not agree, you must not access or use the Services.

These Terms apply to your use of HidzoVPN’s websites, mobile and desktop applications, backend infrastructure, and any software provided by HidzoVPN (collectively, the “Services”). Your use of the Services is also subject to our Privacy Policy, which explains how we handle personal data.

1. Eligibility and Accounts

HidzoVPN is intended for users who are 18 years or older. By registering, you confirm that you meet this requirement or that you have legal authority to accept these Terms on behalf of an organization.

To access HidzoVPN, you must create an account. You may register using your email address with one-time password (OTP) login. You are responsible for the accuracy of the information you provide and for maintaining the security of your account. Any activity under your account is your responsibility. If you suspect unauthorized access, please notify us immediately.

2. Service Plans and Payments

HidzoVPN offers both a free plan and premium subscription plans. Premium subscriptions are available on a monthly, quarterly, or annual basis. Subscription fees are billed in advance and renewed manually.

If you do not wish to continue with a paid subscription, you may cancel through your account settings.

We reserve the right to modify pricing, introduce new features, or adjust service plans. Any material changes will be communicated in advance.

3. License and Software Terms

To use HidzoVPN, you may need to install our mobile or desktop applications. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the software solely for accessing the Services. The software is licensed, not sold, and HidzoVPN retains all ownership rights, trademarks, and intellectual property.

If you download the application from the Apple App Store or Google Play, your use of the software is also subject to their respective licensing terms.

By providing us with feedback or suggestions, you grant us a worldwide, royalty-free, and irrevocable license to use and incorporate it without compensation or attribution.

4. Acceptable Use and Prohibited Activities

You agree not to use HidzoVPN for any illegal, harmful, or abusive purposes. This includes but is not limited to: engaging in fraud, distributing malware, spamming, violating intellectual property rights, attempting to gain unauthorized access to networks, or using the Services in connection with military or cyber warfare activities.

You may not reproduce, resell, sublicense, or otherwise exploit the Services for commercial purposes without our prior written consent. If suspicious or irregular behavior is detected, we may suspend or terminate your access without notice.

5. Suspension and Termination

We may suspend or terminate your Account and access to the Services if:

We are unable to process your renewal.
You violate these Terms (especially Section 6: Prohibited Use).
We are required to do so by law or court order.
You engage in behavior that risks the security or performance of the Services.

Where reasonable, we will notify you in advance. However, we may suspend or terminate your access without notice in serious or urgent cases.

You can terminate your use of the Services at any time. If you wish to delete your account and all related data, follow the account deletion steps in our Privacy Policy.

Upon termination, your license to use the Services is revoked, and you must cease all use. You will lose access to the Software and any stored data. Some clauses (such as intellectual property, warranties, indemnity, and limitation of liability) will survive termination.

6. PROHIBITED USE

You agree NOT to use the Services for or in connection with:

Any illegal, unlawful, fraudulent, or harmful activity.
Sending spam, phishing, DDoS attacks, scraping, or data harvesting.
Distributing viruses or malicious code.
Violating intellectual property rights or data privacy laws.
Child exploitation or harmful/hateful content.
Gaining unauthorized access to networks, systems, or data.
Military use, weapon development, or cyber warfare.
Circumventing security or technical limitations of the Services.
Reproducing, reselling, sublicensing, or modifying the Software or Services.
Behaving abusively toward Nebula staff or other users.
Accessing the Services after being banned or suspended.

We use automated tools to monitor for violations. If irregular or suspicious behavior is detected, your access may be suspended or terminated.

7. Third-Party Services and Components

The Services may include integrations with third-party providers, such as cloud hosting platforms, email/OTP delivery services, analytics tools, and app store services. While these are necessary for HidzoVPN to function, each is governed by its own terms and policies. HidzoVPN is not responsible for the reliability or availability of third-party services, which you use at your own risk.

8. Intellectual Property

All rights, title, and interest in HidzoVPN, including our software, trademarks, branding, and content, remain our exclusive property or that of our licensors. You may not copy, modify, distribute, or reverse-engineer any part of the Services without written permission.

9. Disclaimers

The Services are provided “as is” and “as available,” without warranties of any kind, express or implied. HidzoVPN does not guarantee uninterrupted or error-free operation, nor does it warrant that the Services will meet your expectations or be compatible with every device or network. To the fullest extent permitted by law, we disclaim all warranties, including merchantability and fitness for a particular purpose.

10. Limitation of Liability

Use of HidzoVPN is at your own risk.

We are not liable for:

Direct, indirect, incidental, punitive, or consequential damages.
Loss of data, profits, or business.
Service interruptions due to third-party networks or events beyond our control.

In any case, our total liability will not exceed what you paid us in the 12 months prior to the event giving rise to the claim.

11. Indemnification

You agree to indemnify and hold harmless HidzoVPN Inc., its officers, employees, and affiliates from any claims, damages, or expenses arising from your misuse of the Services, your violation of these Terms, or your violation of applicable laws.

12. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of [INSERT JURISDICTION]. Any disputes will be subject to the exclusive jurisdiction of the courts located in [INSERT LOCATION], unless applicable consumer protection laws provide otherwise.

13. Class Action Waiver

To the extent permitted by law, you agree that disputes will be resolved on an individual basis and not as part of a class action, consolidated, or representative proceeding. No arbitrator or judge may consolidate your claims with those of others without our consent.

14. Miscellaneous

Availability. HidzoVPN Services may be unavailable from time to time due to maintenance, updates, force majeure, or other unforeseen issues. We are not liable for any interruptions.

Modification. We may update or discontinue the Services or any part thereof at our discretion. In such cases, we will provide reasonable notice where possible. If you prepaid for Services that are permanently discontinued, a prorated refund may be issued.

Severability. If any part of these Terms is found unenforceable, the remaining sections shall remain valid and in effect.

Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. HidzoVPN may assign its rights to affiliates or as part of a merger or acquisition.

Data Charges. You are responsible for any internet or data charges incurred while using our Services.

Third-Party Components. The Software may include or interact with third-party elements. These are subject to their respective licenses and terms. HidzoVPN disclaims any warranties related to third-party components.

Internet Connection. A stable internet connection is required to use the Services.

Export Compliance. You may not use or export HidzoVPN Services in violation of applicable export laws or regulations. You affirm you are not located in an embargoed country or listed on any government sanctions list.

Force Majeure. We are not liable for failure or delay in performance due to causes beyond our control, including natural disasters, wars, governmental actions, or service interruptions.

No Reliance. These Terms constitute the entire agreement between you and HidzoVPN. You confirm that you are not relying on any prior statements or representations not contained in these Terms.

Prevailing Language. The English version of these Terms prevails over any translation. In case of discrepancy, the English version shall control.
